Dispute Resolution Process

  1. Notification: Any Marketplace Associate who has a dispute with another Marketplace Associate or with the Community Council must first notify the other party of the dispute and attempt to resolve the issue through direct communication.
  2. Mediation: If direct communication is unsuccessful, the parties may attempt to resolve the dispute through mediation. Mediation is a voluntary process in which a neutral third party works with the parties to help them reach a mutually acceptable resolution.
  3. Arbitration: If mediation is unsuccessful, the parties may agree to resolve the dispute through binding arbitration. Arbitration is a process in which a neutral third party hears evidence from both sides and makes a final decision that is binding on both parties.
  4. Governing Law: Any disputes that cannot be resolved through mediation or arbitration will be subject to the governing law of the jurisdiction in which Turtle Island Marketplace is based.
  5. Legal Action: In the event that a dispute cannot be resolved through mediation or arbitration, either party may pursue legal action through the appropriate channels.
